1. Introduction and Acceptance
1.1 Effective Date
These Terms of Service ("Terms") are effective as of August 20, 2025.
1.2 Agreement
These Terms constitute a legally binding agreement between Infinea Consulting Tanácsadó és Fejlesztő Korlátolt Felelősségű Társaság, a company registered in Hungary with registered address at Andor utca 21/c fszt. 1., 1119 Budapest, Hungary, VAT ID: HU14930883 ("Infinea," "we," "us," or "our") and you ("User," "you," or "your"), whether personally or on behalf of an entity, concerning your access to and use of the Product Classifier service, including our web application, API, and any related services (collectively, the "Service").
1.3 Acceptance
By accessing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
1.4 Authority to Accept
By accepting these Terms, you represent and warrant that:
- You are at least 16 years of age
- You are accessing and using the Service solely for business or professional purposes
- If accepting on behalf of an entity, you have the legal authority to bind that entity to these Terms
- You are not accessing the Service for personal, household, or consumer purposes
1.5 Additional Terms
Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Additional terms may apply to specific features or functionality of the Service, and such terms will be disclosed to you when you access those features.
2. Definitions
For the purposes of these Terms, the following definitions apply:
"Account" means a unique account created for you to access and use the Service, identified by your email address and associated with your organization.
"API" means the application programming interface provided by Infinea that allows programmatic access to the Service's product classification functionality.
"API Key" means the unique authentication credential issued to your Account that enables access to the API.
"Credits" means the units of usage allocated to your Account based on your Subscription plan. The number of Credits consumed per classification request may vary based on the type of classification, AI model used, and features selected.
"Custom Instructions" means user-defined rules or guidance provided to enhance the AI's classification accuracy for specific use cases.
"Paddle" means Paddle.com Market Ltd, our third-party payment processor that handles billing and payment transactions.
"Playground" means the web-based interface of the Service where Users can manually input products for classification and test the Service functionality.
"Product Classifier" means the AI-powered service that analyzes product descriptions and assigns appropriate category classifications based on selected Taxonomies.
"Service" means the Product Classifier platform provided by Infinea, including the Playground interface, API access, and all related features and functionality.
"Subscription" means the paid plan selected by you that determines your access level, available features, and Credit allocation.
"Taxonomy" means a hierarchical classification system for organizing products into categories, including but not limited to Google Product Taxonomy, Shopify Standard Product Taxonomy, and other supported classification systems.
"User Content" means any data, text, or product descriptions that you submit to the Service for classification, including through the Playground or API.
"User" or "you" means the individual or legal entity that has registered for an Account and accepted these Terms, including any employees or agents authorized to access the Service on behalf of such entity.
3. Account Registration and Requirements
3.1 Business Use Only
The Service is designed exclusively for business and professional use. By registering for an Account, you represent and warrant that you are registering on behalf of a business entity or for professional purposes and not for personal, household, or consumer use.
3.2 Registration Information
To create an Account, you must provide accurate, complete, and current information, including:
- A valid business email address
- Your company name and business address
- Your country of operation
- VAT identification number (where applicable)
- Any other information we may reasonably request
3.3 Account Security
You are responsible for:
- Maintaining the confidentiality of your Account credentials, including login codes and API Keys
- All activities that occur under your Account
- Immediately notifying us of any unauthorized use of your Account
- Ensuring that your Account information remains accurate and up-to-date
We are not liable for any loss or damage arising from your failure to maintain the security of your Account.
3.4 Account Restrictions
You agree that you will not:
- Share your Account credentials with any third party
- Create multiple Accounts for the same organization without our express permission
- Use another User's Account without authorization
- Sell, transfer, or assign your Account to another party
- Register for an Account if you are under 16 years of age
3.5 Account Verification
We reserve the right to verify the accuracy of your registration information and your eligibility to use the Service. This may include requesting additional documentation to confirm your business status or identity. Failure to provide requested verification may result in Account suspension or termination.
3.6 Account Suspension and Termination
We may suspend or terminate your Account immediately if:
- You breach any provision of these Terms
- We suspect fraudulent, abusive, or illegal activity
- You fail to provide accurate registration information or requested verification
- You fail to pay any fees when due
- Required by law or court order
4. Service Description
4.1 Product Classification Functionality
The Service provides AI-powered product classification that analyzes product descriptions and automatically assigns appropriate categories based on your selected Taxonomy. The classification process is designed to help businesses organize and categorize their product catalogs efficiently.
4.2 Available Interfaces
The Service is accessible through two primary interfaces:
Playground Interface: A web-based interface available to all registered Users where you can:
- Input product descriptions for immediate classification
- Select between available Taxonomies
- Configure classification settings
- Apply Custom Instructions to refine results
- Test and evaluate classification accuracy
API Access: Programmatic access that enables:
- Bulk product classification
- Integration with your existing systems
- Automated classification workflows
- Consistent application of your classification settings
4.3 Supported Taxonomies
The Service currently supports the following classification systems:
- Google Product Taxonomy
- Shopify Standard Product Taxonomy
- Custom Taxonomies (available upon request through our support team)
To implement a custom Taxonomy, you must contact our support team at support@productclassifier.com. Custom taxonomy implementation typically requires 5 business days for processing. Additional costs may apply depending on your subscription plan and will be determined through discussion with our support team. To qualify for implementation, your taxonomy must be hierarchical in structure and provided as a text file where each row represents a complete taxonomy entry. We will assess the feasibility of accommodating your specific requirements based on these criteria.
4.4 Custom Instructions
You may provide Custom Instructions to enhance classification accuracy for your specific use case. These instructions:
- Apply to both Playground and API classification requests
- Guide the AI to better understand your product catalog
- Can include industry-specific terminology or classification preferences
- Are saved to your Account for consistent application
4.5 Credit Usage
All classification requests, whether made through the Playground or API, consume Credits from your Account balance. The number of Credits required per classification may vary based on factors including but not limited to:
- The complexity of the classification request
- The selected AI model or processing tier
- Additional features or processing options selected
Current credit consumption rates can be found on the "Billing" page in your Account dashboard and may be updated with reasonable notice. Detailed credit consumption logs showing individual usage events are available on the "Event logs" page and are retained for 45 days.
4.6 Service Limitations
The Service is provided for business classification purposes only. While we strive for high accuracy, the Service:
- Provides automated suggestions that should be reviewed for accuracy
- May not be suitable for regulated industries requiring certified classification
- Is dependent on the quality and completeness of input product descriptions
- Should not be used as the sole basis for legal, tax, or compliance decisions
5. Acceptable Use Policy
5.1 Permitted Uses
The Service is provided exclusively for legitimate business purposes. Permitted uses include:
- Classifying products for e-commerce catalogs
- Organizing inventory for business operations
- Integrating product classification into business workflows
- Testing and evaluating classification accuracy for commercial products
- Training staff on product categorization standards
- Analyzing product data for business intelligence purposes
5.2 Prohibited Uses
You agree not to use the Service for any of the following purposes:
Illegal or Harmful Activities
- Any activity that violates applicable laws or regulations
- Classification of illegal, counterfeit, or prohibited products
- Facilitating fraud, money laundering, or other criminal activities
- Violating intellectual property rights of others
System Abuse
- Attempting to bypass or circumvent usage limits or security measures
- Reverse engineering, decompiling, or disassembling the Service
- Using automated systems or bots to create Accounts or access the Service beyond API limits
- Attempting to gain unauthorized access to our systems or other Users' Accounts
- Introducing malware, viruses, or other harmful code
Commercial Exploitation
- Reselling, sublicensing, or redistributing the Service without explicit written authorization
- Creating a competing service using our classification results
- Selling or transferring Credits between Accounts
- Using the Service as a backend for your own commercial classification service without agreement
Misuse of Resources
- Submitting content unrelated to product classification
- Using the Service for general-purpose text analysis beyond product categorization
- Excessive API calls that degrade service performance for other Users
- Submitting duplicate requests to manipulate usage statistics
5.3 Rate Limits and Fair Use
To ensure Service availability for all Users, we implement:
- API rate limiting based on your Subscription tier
- Maximum request size limitations
- Concurrent request restrictions
- Daily and monthly usage caps as defined by your plan
Specific limits are displayed on the Billing page in your Account dashboard and in the API documentation.
5.4 Content Standards
When submitting product descriptions for classification, you must ensure the content:
- Relates to actual products or services
- Does not contain hate speech, harassment, or discriminatory language
- Does not include personal data of individuals
- Is not obscene, defamatory, or otherwise objectionable
5.5 Monitoring and Enforcement
We reserve the right to:
- Monitor usage patterns to detect violations
- Investigate suspected violations of this policy
- Suspend or terminate Accounts that violate these terms
- Report illegal activities to appropriate authorities
- Seek legal remedies for violations that cause harm to our Service or other Users
5.6 Reporting Violations
If you become aware of any violation of this Acceptable Use Policy, please report it immediately to support@productclassifier.com.
6. User Content and Intellectual Property
6.1 Your Content Ownership
You retain all rights, title, and interest in and to any User Content that you submit to the Service for classification. We do not claim ownership of your product descriptions, data, or any other content you provide.
6.2 License Grant to Infinea
By submitting User Content to the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to:
- Process your content through our classification algorithms
- Store your content temporarily as necessary to provide the Service
- Display your content back to you through the Service interfaces
- Use your content to generate classification results
- Create anonymized and aggregated insights that do not identify you or your products
This license automatically terminates when you delete your content or terminate your Account, except for anonymized data that cannot be associated with you.
6.3 Accuracy and Warranties
You acknowledge that:
- Classification results are AI-generated suggestions and may not be 100% accurate
- We make no warranty regarding the accuracy, completeness, or suitability of classifications
- You are responsible for reviewing and verifying all classification results
- The Service is not a substitute for human judgment in critical business decisions
6.4 Infinea's Intellectual Property
The Service, including all software, algorithms, designs, features, and documentation, is the exclusive property of Infinea and is protected by intellectual property laws. You acknowledge that we own all rights in:
- The Product Classifier technology and algorithms
- Our user interfaces and API design
- Our taxonomies and classification methodologies
- Any improvements or derivatives of our technology
- Our trademarks, logos, and brand elements
6.5 Restrictions on Use
You may not:
- Copy, modify, or create derivative works of the Service
- Decompile, reverse engineer, or attempt to extract source code
- Remove or alter any proprietary notices or labels
- Use our trademarks without express written permission
- Claim any ownership rights in the Service or its outputs
6.6 Feedback and Suggestions
If you provide feedback, suggestions, or recommendations regarding the Service ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use such Feedback for any purpose without compensation to you. We may incorporate Feedback into the Service without obligation or attribution.
6.7 Third-Party Content
The Service may display or reference third-party taxonomies (such as Google Product Taxonomy or Shopify Standard Product Taxonomy). Such third-party content remains the property of its respective owners, and your use is subject to any applicable third-party terms.
7. Subscription Plans and Billing
7.1 Subscription Plans
We offer various subscription plans with different features, Credit allocations, and pricing. Current plans, features, and pricing are displayed on our website and in your Account dashboard. By subscribing, you agree to the plan terms as described at the time of your subscription.
7.2 Credit System
Credits are the units of consumption for the Service:

Each classification request consumes Credits from your monthly allocation

Credit consumption rates are specified in your Account dashboard and may vary based on:
- AI model capabilities and processing requirements
- Cascading classification with multiple models
- Image classification features
- Other advanced features as introduced
Unused Credits do not roll over to subsequent billing periods and expire at the end of each monthly cycle.
7.3 Payment Processing
All payments are processed by our third-party payment processor, Paddle.com Market Ltd ("Paddle"). By subscribing to the Service:
- You enter into a direct contractual relationship with Paddle for payment processing
- Paddle will charge your selected payment method immediately upon subscription
- You authorize Paddle to charge applicable taxes based on your jurisdiction
- All invoices and receipts will be provided electronically by Paddle
Your relationship with Paddle is governed by Paddle's Terms of Service, available at https://www.paddle.com/legal/terms.
Paddle accepts various payment methods including credit/debit cards and PayPal. Payment authorization must be successful for your subscription to activate.
7.4 Billing Cycle and Auto-Renewal
- Subscriptions are billed on the frequency specified in your selected plan (monthly, annually, or as otherwise offered)
- Your subscription will automatically renew at the end of each billing period
- Renewal charges will be processed using your payment method on file with Paddle
- You will receive notification of upcoming renewals as required by law
To prevent auto-renewal, you must cancel your subscription before the next billing date.
7.5 Plan Changes
We may introduce new plans, modify existing plans, or discontinue plans at any time. Changes to plans affect new subscriptions immediately and existing subscriptions at the next renewal. You will be notified of any changes affecting your current subscription.
7.6 Cancellation Policy
- You may cancel your subscription at any time through your Account settings
- Cancellation takes effect at the end of your current billing period
- No refunds are provided for partial billing periods or unused Credits
- Upon cancellation, you retain access to the Service until the end of your paid period
- Your Account and historical classification data remain accessible after cancellation
- You may resubscribe at any time to restore full Service access
7.7 Price Changes
We reserve the right to modify subscription prices with 30 days' advance notice. Price changes will apply to your next renewal period. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.
7.8 Refund Policy
Due to the digital nature of our Service and immediate availability of Credits upon payment:
- We do not offer refunds for subscriptions after payment is processed
- Exceptions may be made at our sole discretion for technical issues preventing Service access
- Refund requests should be directed to support@productclassifier.com
7.9 Taxes and VAT
- All prices are exclusive of applicable taxes unless otherwise stated
- Paddle calculates and collects appropriate taxes based on your location and applicable laws
- You are responsible for providing accurate tax information, including VAT numbers
- Paddle will provide tax-compliant invoices for your records
- You remain responsible for your own tax obligations and reporting in your jurisdiction
7.10 Payment Failures
If payment authorization fails:
- Paddle may retry the charge according to their retry schedule
- Continued payment failure may result in subscription suspension
- We reserve the right to terminate Accounts with persistent payment failures
- You remain responsible for any outstanding amounts owed
8. API Terms
8.1 API Key Security
Your API keys are unique credentials that authenticate your access to the Service. You are responsible for:
- Maintaining the confidentiality of all API keys associated with your Account
- Implementing appropriate security measures to protect API keys from unauthorized access
- Immediately rotating API keys if you suspect they have been compromised
- Not sharing API keys publicly or embedding them in client-side code
- All usage and activities performed using your API keys
We may revoke or regenerate API keys if we detect security concerns or violations of these Terms.
8.2 Technical Integration Requirements
To use our API, you must:
- Comply with the technical specifications and integration guidelines provided in our API documentation
- Implement proper error handling and respect all API response codes
- Use secure HTTPS connections for all API requests
- Include valid API authentication with each request
- Ensure your integration does not circumvent any Service limitations

8.3 Rate Limiting
API usage is subject to rate limits to ensure fair access and Service stability:
- Rate limits are determined by your subscription plan
- Current limits are displayed in your Account dashboard
- Exceeding rate limits will result in temporary request rejection
- Persistent violations may result in API access suspension
You must implement appropriate throttling in your applications to stay within allocated limits.
8.4 Versioning and Changes
- We may release new API versions to introduce features or improvements
- We will maintain backward compatibility for a reasonable deprecation period
- Major changes will be announced with advance notice via email and documentation updates
- You are responsible for updating your integration within announced timelines
- Deprecated API versions may be discontinued after the notice period
8.5 Acceptable API Use
In addition to our general Acceptable Use Policy, API usage must:
- Not attempt to reverse engineer or extract our underlying models
- Respect the intended purpose of each endpoint
- Not be used to create a competitive service without written agreement
- Include appropriate user agent strings to identify your application
- Not manipulate or spoof request origins
8.6 Support
API support is provided according to your subscription plan:
- Technical documentation is available to all API users
- Support response times and channels may vary by subscription tier
- Critical API issues affecting multiple users will be prioritized
- Feature requests and enhancement suggestions are welcomed but not guaranteed

8.7 Service Level and Availability
- We strive to maintain high API availability but do not guarantee specific uptime percentages
- Scheduled maintenance will be announced in advance when possible
- API performance may vary based on request complexity and system load
- We are not liable for any damages resulting from API unavailability or performance issues
8.8 Data Formats and Limitations
- API requests and responses must conform to documented formats
- Maximum request sizes and response limits are specified in the API documentation
- Bulk operations may be subject to additional restrictions
- Character encoding must be UTF-8 for all text data
9. Data Processing and Privacy
9.1 Privacy Policy
Our collection, use, and processing of personal data is governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy, available at [productclassifier.com/privacy].
9.2 Data Processing Relationship
When you submit User Content for classification:
- You act as the data controller for any personal data within your User Content
- We act as a data processor, processing data solely on your instructions
- You are responsible for ensuring you have appropriate legal basis to submit any personal data
9.3 Your Data Protection Obligations
You represent and warrant that:
- You have obtained all necessary consents and rights to submit User Content to the Service
- Your use of the Service complies with applicable data protection laws, including GDPR
- You will not submit sensitive personal data or special categories of data for classification
- You will respond promptly to any data subject requests related to data you submit
9.4 Data Processing Agreement
For customers requiring a formal Data Processing Agreement (DPA) under GDPR Article 28, please contact us at support@productclassifier.com. Our standard DPA incorporates:
- Appropriate technical and organizational measures
- Obligations regarding sub-processors
- Assistance with data subject rights
- Data deletion and return provisions
9.5 International Data Transfers
As detailed in our Privacy Policy, your data may be processed outside the European Economic Area. We ensure appropriate safeguards are in place for all international transfers, including Standard Contractual Clauses where required.
9.6 Security Measures
We implement comprehensive security measures as described in our Privacy Policy. These include encryption, access controls, and regular security assessments to protect your data.
9.7 Data Retention
- Classification results and User Content are retained according to the periods specified in our Privacy Policy
- You may request deletion of your data at any time through your Account settings

10. Service Availability and Support
10.1 Service Availability
We strive to maintain high availability of the Service but do not guarantee any specific uptime percentage or service level agreement (SLA). The Service is provided on a "best effort" basis, which means:
- We aim for continuous availability but cannot guarantee uninterrupted access
- Service performance may vary based on factors including system load and complexity of requests
- Availability metrics, when displayed, are for informational purposes only and do not constitute a warranty
10.2 Maintenance Windows
- We may perform scheduled maintenance that could result in Service unavailability
- Planned maintenance will be announced via email and dashboard notifications with reasonable advance notice
- Emergency maintenance may be performed without prior notice to address critical issues
- We will endeavor to schedule maintenance during periods of low usage when possible

10.4 Support Response Times

- Substantive response: Based on issue priority and subscription plan
- Business hours: Monday to Friday, 9:00 AM - 5:00 PM CET (excluding Hungarian public holidays)
Response times are targets only and not guaranteed service levels.
10.5 Support Scope
Our support includes assistance with:
- Account and billing issues
- Technical problems accessing the Service
- API integration questions
- General usage guidance
- Bug reports and feature requests
Support does not include:
- Custom development or integration services
- Training beyond standard documentation
- Troubleshooting of your internal systems
- Legal or tax advice
10.6 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including:
- Adding or removing features
- Changing API endpoints or functionality
- Modifying user interfaces
- Adjusting system requirements
Material changes will be communicated with reasonable advance notice, except where changes are required for security, legal, or emergency reasons.
10.7 Service Interruptions
In the event of Service interruptions:
- We will work diligently to restore Service as quickly as possible
- Status updates will be provided through appropriate channels
- We are not liable for any losses resulting from Service unavailability
- Credits or refunds for downtime are not provided unless explicitly offered at our discretion
11. Disclaimers and Limitations of Liability
11.1 "As Is" Service Provision
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.2 No Warranty on Accuracy
We specifically do not warrant that:
- Classification results will be accurate, complete, or error-free
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- Any errors in the Service will be corrected
- The results obtained through the Service will be suitable for any particular purpose
11.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Liability Cap: Our total liability to you for all claims arising out of or relating to these Terms or the Service, regardless of the form of action, will not exceed the amount paid by you to us in the twelve (12) months preceding the claim.
Excluded Damages: In no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business
- Loss of data or data use
- Business interruption
- Cost of substitute services
- Any damages based on your reliance on classification results
This limitation applies even if we have been advised of the possibility of such damages.
11.4 Exceptions to Limitations
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under applicable law
11.5 Your Acknowledgments
You acknowledge and agree that:
- You assume full responsibility for your use of the Service
- Your use of the Service is at your sole risk
- You are solely responsible for verifying the accuracy of classification results
- We are not responsible for decisions you make based on Service outputs
- The limitations reflect a reasonable allocation of risk between the parties
11.6 Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- War, terrorism, or civil unrest
- Government actions or sanctions
- Internet service disruptions
- Power outages
- Pandemic or epidemic
- Labor disputes
11.7 Third-Party Services
We are not responsible for any third-party services, including:
- Payment processing by Paddle
- Third-party taxonomies or classification systems
- Your integrations with external systems
- Internet connectivity or infrastructure
Your use of third-party services is governed by their respective terms and policies.
12. Indemnification
12.1 Your Indemnification Obligations
You agree to defend, indemnify, and hold harmless Infinea Consulting Tanácsadó és Fejlesztő Korlátolt Felelősségű Társaság, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers (collectively, "Infinea Parties") from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use or misuse of the Service
- Your User Content, including any claim that it infringes or violates any third-party rights
- Your violation of applicable laws or regulations
- Any unauthorized access to or use of the Service through your Account
- Your negligence or willful misconduct
- Any products or services you classify, market, or sell using the Service
- Your breach of any representations or warranties made in these Terms
12.2 Indemnification Process
If we seek indemnification from you:
- We will promptly notify you of any claim for which we seek indemnification
- You will have the right to assume control of the defense with counsel of your choice
- We will reasonably cooperate with your defense at your expense
- You may not settle any claim that imposes liability on us without our prior written consent
- We may participate in the defense with our own counsel at our expense
12.3 Exclusions from Indemnification
Your indemnification obligations do not apply to claims arising solely from:
- Our gross negligence or willful misconduct
- Our breach of these Terms
- Claims that the Service itself, when used within the scope of these Terms, infringes third-party intellectual property rights
12.4 Survival
This indemnification provision will survive any termination or expiration of these Terms and your use of the Service.
13. Termination
13.1 Termination Options
You may end your relationship with the Service in two ways:
Subscription Cancellation
- Cancel your subscription through your Account settings
- Your Account remains active with access to historical data
- Service access continues until the end of your current billing period
- You can resubscribe at any time to restore full Service functionality
Account Deletion
- Delete your Account through your Account settings or by contacting support@productclassifier.com
- Your subscription is immediately canceled without refund
- Your Account and all associated data are permanently deleted
- This action is irreversible and data cannot be recovered
13.2 Termination by Infinea
We may suspend or terminate your Account and access to the Service immediately, without prior notice or liability, if:
- You breach any material provision of these Terms
- You fail to pay any fees when due
- We reasonably suspect fraudulent, illegal, or unauthorized activity
- You violate our Acceptable Use Policy
- Required by law, court order, or governmental request
- We discontinue the Service (with 30 days' notice unless circumstances require immediate action)
Termination by Infinea may result in either:
- Suspension of Service access while maintaining Account data, or
- Complete Account deletion with the same effects as user-initiated deletion
13.3 Effect of Subscription Cancellation
When you cancel your subscription:
- You retain access to the Service until the end of your paid period
- After expiration, you can still access your Account to view historical data
- API access is suspended but API keys remain valid for future reactivation
- Classification history follows standard retention (45 days for detailed records, then aggregated data only)
- No new classification requests can be made without an active subscription
13.4 Effect of Account Deletion
When an Account is deleted (whether by you or by Infinea):
- All access terminates immediately
- Your data is permanently deleted with the following exceptions:
Retained for Legal Compliance:
- Payment and billing records: 7 years (Hungarian tax law requirement)
- Transaction logs related to payments: 7 years
Deleted Immediately:
- Account credentials and authentication data
- Product classification history and results
- Custom instructions and preferences
- API keys and access tokens
- Usage logs and credit consumption data
Retained as Required:
- Legal correspondence if related to disputes or investigations
- Records of Terms of Service violations if necessary to prevent re-registration
- Data subject to legal holds or government requests
- Data export is not possible after deletion
- You must export any needed data before initiating Account deletion
- This action cannot be undone
13.5 Data Retention
For active and canceled (but not deleted) Accounts:
- Detailed classification history is retained for 45 days
- After 45 days, only aggregated summaries are kept
- Account settings and preferences are retained indefinitely until Account deletion
13.6 Survival of Terms
The following sections will survive termination of these Terms:
- Section 6 (User Content and Intellectual Property)
- Section 9 (Data Processing and Privacy)
- Section 11 (Disclaimers and Limitations of Liability)
- Section 12 (Indemnification)
- Section 14 (Governing Law and Disputes)
- Section 15 (General Provisions)
- Any other provisions that by their nature should survive
13.7 Reactivation
After Subscription Cancellation:
- You may resubscribe at any time through your Account
- Your historical data and settings remain available
- API keys can be reactivated upon resubscription
After Account Deletion:
- You must create a new Account
- Previous data cannot be recovered
- Accounts deleted by Infinea for violations may not create new Accounts without written consent
14. Governing Law and Disputes
14.1 Governing Law
These Terms and any dispute arising out of or related to them, the Service, or your relationship with Infinea shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions.
14.2 Jurisdiction
You agree that any judicial proceeding to resolve disputes relating to these Terms or the Service will be brought in the competent courts of Budapest, Hungary, and you hereby consent to the exclusive jurisdiction and venue of such courts.
14.3 Attempt at Amicable Resolution
Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute, claim, or controversy through good faith negotiations. The party raising the dispute must provide written notice to the other party describing the nature and basis of the claim and the requested relief. The parties shall then attempt to resolve the dispute through direct discussion for a period of at least 30 days.
14.4 Language of Proceedings
All legal proceedings, communications, and documentation related to any dispute shall be conducted in Hungarian or English, at the discretion of the initiating party. If translation is required, the party requiring translation shall bear the associated costs.
14.5 Waiver of Jury Trial
TO THE EXTENT PERMITTED BY LAW, EACH PARTY HEREBY WAIVES ANY RIGHT TO JURY TRIAL IN CONNECTION WITH ANY ACTION OR LITIGATION ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.
14.6 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You may not bring claims against us in a purported class or representative proceeding.
14.7 Limitation Period
Any cause of action or claim you may have arising out of or relating to these Terms or the Service must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.
14.8 Injunctive Relief
Notwithstanding the above provisions, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidential information, or these Terms.
14.9 Costs and Fees
Unless otherwise required by law, each party shall bear its own costs and attorneys' fees in any dispute. However, if either party prevails on a statutory claim that affords the prevailing party attorneys' fees, or if there is a judicial determination that a party brought a claim or defense without substantial justification, the court may award costs and fees to the prevailing party.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Infinea regarding the Service and supersede all prior and contemporaneous agreements, proposals, representations, and understandings concerning the subject matter.
15.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be severed from these Terms. The validity, legality, and enforceability of the remaining provisions shall not be affected.
15.3 No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms must be in writing and signed by an authorized representative of Infinea.
15.4 Assignment
You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. Any attempted assignment in violation of this provision shall be null and void. We may freely assign these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties and their respective successors and permitted assigns.
15.5 Notices
All notices required under these Terms shall be in writing and shall be deemed given:

15.6 Relationship of Parties
Nothing in these Terms creates or implies any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Infinea. You have no authority to make or accept any offers or representations on our behalf. You will not make any statement that reasonably would contradict this section.
15.7 Force Majeure
Neither party shall be liable for any failure or delay in performance under these Terms arising from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
15.8 Interpretation
The headings used in these Terms are for convenience only and shall not affect the interpretation of these Terms. The words "include," "includes," and "including" shall be deemed to be followed by "without limitation." These Terms shall be construed without regard to any presumption or rule requiring construction against the party causing these Terms to be drafted.
15.9 Electronic Communications
By using the Service, you consent to receiving electronic communications from us. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
15.10 Export Compliance
You may not use, export, or re-export the Service except as authorized by Hungarian law, EU regulations, and the laws of the jurisdiction in which the Service was obtained. You represent and warrant that you are not located in any embargoed country or prohibited by any applicable laws from receiving the Service.
16. Changes to Terms
16.1 Right to Modify
We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. Changes may be necessary due to:
- Legal or regulatory requirements
- Changes in our Service features or functionality
- Business or operational reasons
- Security or privacy enhancements
- Industry best practices
16.2 Notice of Material Changes
For material changes to these Terms:
- We will provide at least 30 days' advance notice via email to the address associated with your Account
- We will post a prominent notice on our Service dashboard
- We will update the "Effective Date" at the beginning of these Terms
- We may provide additional notice through the Service interface
Material changes include modifications that significantly affect your rights or obligations under these Terms.
16.3 Notice of Non-Material Changes
For non-material changes:
- We will update these Terms without advance notice
- The updated Terms will be posted on our website
- The "Effective Date" will be updated to reflect the revision date
Non-material changes include clarifications, corrections, or administrative updates that do not significantly impact your use of the Service.
16.4 Your Acceptance of Changes
By continuing to access or use the Service after any changes to these Terms become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms:
- You must stop using the Service
- You may cancel your subscription before the changes take effect
- Your continued use constitutes acceptance of the modified Terms

We encourage you to periodically review these Terms to stay informed of any updates. The date of the most recent revision will always be indicated at the top of this document.
16.6 Version History
Upon request to support@productclassifier.com, we can provide information about material changes made to previous versions of these Terms, subject to our record retention policies.
16.7 Conflicting Terms
In the event of a conflict between these Terms and any future modifications, the most recent version of the Terms shall prevail unless explicitly stated otherwise.
